Why Administrative Discretion is Necessary
The flexibility of exercising decision making is called administrative discretion. This
discretion is allowed to those administrators who are within the public. By doing this,
administrators are to exercise professional judgement. Discretion give administrators the power
to make decision that affect the day to day operation of the organization. It also allows the
administrators to serve the public in a way the displays the values and beliefs that serve as a
reflection. Within the administrative law, the term discretion defines the agencyÂ’s function, as
well as the role that the court plays.
Administrative discretion is both necessary and desirable for implementing public
policies, because those who are put in place as decision makers are obligated to use discretionary
power. That power should be in good faith and should be intended for those who are authorized
to make those decisions. Administrator are not allowed to act outside of their powers, because
this would be considered an abuse of authority. Some administrators may make decision based
off of feelings, but this is an insufficient way to exercise discretion. This is insufficient and not
acceptable, because it can present conflict of interest and jeopardize professional values of the
agency. Also, administrators must also have regard to requirements with the administrative law.
They must be able to act in good faith, comply procedures for the legislature, make decisions that
are based on relevant facts, provide fairness to those who are affected by the administrative law,
and exercise discretion.
To be more specific, administrative discretion is both necessary and desirable for
implementing public policies, because there is a level of complexity within the decision-making
process.
